David Fornal

David focuses his practice in matters of general litigation. He is admitted to practice law in New Jersey, Pennsylvania, the United States District Court from the District of New Jersey and the United States District Court for the Eastern District of Pennsylvania.

In 2002, David graduated from Muhlenberg College, in Allentown, Pennsylvania, with a Bachelor of Arts degree in History and a secondary education certification. During the Spring of 2001, he studied abroad at the Lorenzo di Medici Institute in Florence, Italy. David earned his law degree, magna cum laude, from Widener University School of Law in 2005. While attending law school, David regularly competed as a member of the Moot Court Honor Society and the Moe Levine Trial Advocacy Honor Society.

After completing law school, David served as Judicial Law Clerk to the Honorable Linda R. Feinberg, Assignment Judge of the Superior Court, Law Division, Mercer County. While clerking, he handled a variety of civil and criminal matters including prerogative writs, requests pursuant to the Open Public Records Act, election issues and matters related to the State Grand Jury. David is also trained and certified as a mediator through the Administrative Office of the Courts. During his clerkship, David successfully settled and mediated many disputes in the Special Civil Part, Small Claims Division.

While working at Maselli Warren, David has represented institutional lenders, small businesses and individuals in litigation related to dissolution proceedings, intellectual property, employment disputes, breach of contract actions, landlord/tenant rights, violations of the New Jersey Consumer Fraud Act and contested wills and estates. David is also well versed in commercial collections, the rights of mortgagees and mortgagors in New Jersey foreclosures and the rights of creditors to repossess and protect collateral. In the United States Bankruptcy Court for the District of New Jersey, David regularly represents secured creditors in Chapter 11 bankruptcies, adversary proceedings for the non-dischargeability of claims, disputes related to the extent, priority and validity of liens and negotiations for adequate protection payments and replacement liens in cash collateral orders.

In both 2009 & 2010, New Jersey Super Lawyers (www.superlawyers.com) has recognized David as a Rising Star in the areas of General Litigation, Bankruptcy and Creditor/Debtor Rights. In the Rising Stars section, New Jersey Super Lawyers recognizes the top up-and-coming young attorneys in each state who are 40 years old or younger or have been practicing for 10 years or less. The Rising Stars selection process includes peer nominations and independent research of professional achievements, and the listing is not approved or passed on by the Supreme Court of New Jersey. No more than 2.5% of the attorneys in the state are recognized and designated as Rising Stars.

In the local community, David is an active Rotarian and will serve as the 2009-2010 Sergeant-at-Arms for the Rotary Club of Hamilton Township. Originally from Hamilton, New Jersey, David currently resides in the Borough of Hopewell with his family.
